be a Bonafide Occupational Qualification
(BFOQ).
Employment forms
and procedures must
be checked carefully to insure that no one
is excluded from a pool of applicants for
reasons that can not be proven to be
directly related to ability to perform the
job for which he or she would have been
hired.
The employer'
must prove,he or she has
only used BFOQs. Failure to keep accurate
records may be considered proof that the
law was
